Implied vs. Expressed Warranties
Beyond any specific written warranty terms a seller provides, it's worth understanding that warranties in general fall into two broad categories: expressed and implied. This is general background information, not legal advice — consult an attorney for guidance specific to your situation.
Expressed Warranties
An expressed warranty is one that's explicitly stated by the seller, in writing or otherwise, such as a written limited lifetime warranty policy.
Implied Warranties
An implied warranty exists separately from any written terms: under the Uniform Commercial Code (UCC), a product sold for a particular purpose is generally understood to carry an implied warranty that it's fit for that purpose, whether or not the seller states so directly. Selling a product explicitly "as-is" is one way sellers may attempt to limit this, though the specifics vary and are governed by applicable law.
